I live in a resale HBD bought in 2021 without any HBD grant or loan and I wish to buy a property in Malaysia. Do I need to sell my HDB flat in Singapore in order to buy Msian property. I need to buy New unit from Developer.

You are not allowed to purchase any residential property regardless in Singapore or overseas during your 5 years Minimum Occupation Period after purchasing a HDB, whether or not there is any loan or grants received.

If you bought your HDB in 2021, you have not met the 5 years MOP and is not eligible to even sell your HDB. As such according to HDB regulations, you are not allowed to purchase any residential property whether in Singapore or overseas for a period of 5 years. If you are a Singaporean, you may purchase an overseas residential property once your 5 years MOP period is up without selling your HDB. However for all SPR household, they are required to sell their HDB before or after (within 6 months) acquiring any private or overseas property. Hi Kasturi,

1) You have to complete the 5 yrs MOP in the current flat before being allowed to buy any private residential properties locally and overseas.
2) This has nothing to do with whether you received any grants or loans from the HDB.
3) It is a mandatory requirement for anyone who bought an HDB flat.
4) If you wish to sell your HDB flat, you will have to seek approval from the HDB since you have not completed your MOP.
5) By doing so, you are also subject to the seller stamp duty of 12/8/4% in the 1st 3 years of your purchase. So likely you will be subject to the 12% or 8% seller stamp duty depending on the exact date you bought and sell.
