Good morning t,

If HDB is able to grant you a special approval to sell due to court order (divorce), you will be able to sell your unit in the resale market. Most likely you dont need to return the grant you received last year. You might want to speak to the HDB officer at the branch office for further clarification.

1) It's a real regrets to hear about your situation.
2) I really hope you still could savage your situation. Your son is still young and he needs a complete family.
3) Nothing will happen to your grant, this is the least you need to worry about.
4) The grant is to assist you to start building your family, once given it will not take back as you did not want such thing happen to your family.
5) As long as you did not violate the law or given false information obtaining the grant. It is yours for giving up your 1st time buyer priviledge.
6) It became part of your CPF OA funds for your next purchase.

Hi Sir,

I'm sorry to hear about your situation.

With regards to the grants that you took for your flat purchase, you need not return it if HDB grants you the approval to sell off the flat in the open market.

However, do take note that as you had just purchased the flat last year, you will be subjected to Seller Stamp Duty (SSD) if you sell the flat within 3 years of purchase. Do take this into consideration when working out the finances for the sale.
