I as a buyer am in a situation where the seller (legal owner) is unable to locate his/her spouse (occupier). The sales & purchase process is currently in final stages with a specified completion date. Due to the abovementioned issue, HDB's legal department is refusing to act in the sale for the seller who were instructed to appoint a private lawyer.

May I know if the sales process will be delayed indefinitely until the occupier is located and/or seller proves they can't find occupier? In that case, what are my recourse as a buyer?

Hi KZ,

In the event that the whole transaction can’t be completed at all, you could consult a law firm if you chose to sue the seller for specific compensation.
