I am currently married and my husband already own a HDB flat before we got married. We are thinking of applying for a BTO under my name but include my husband as an essential occupier and he will be helping to pay with cash. Please advise whether is this possible.
Note:
1) Husband will not be able to sell off his current flat as his parents are staying in that flat
2) We are not looking to buy any private property
3) We are open to buying a resale flat under my name as well if BTO is not an option

Hi Mdm,

I'm sorry to inform you that should you purchase another HDB flat, be it a BTO or a resale flat, your husband will be required to dispose off his current HDB flat latest within 6 months upon the flat purchase.

He could transfer his ownership to his parents if he does not wish to sell the flat. Do take note that his parents will have to have the financial capability to refund the CPF monies he had utilised towards the flat, and settle all outstanding loan balances.

Your case is very common amongst HDB and private property owners alike. However I regret to inform you such scenario is not possible as HDB would require your husband to dispose off his current flat within 6 months of purchasing a new flat be it BTO or resale. Placing his name as an occupier or not even placing his name at all won't make any difference as HDB is very strict on this policy and does not allow married couples to own a different HDB unit each. What your husband may want to consider is transferring out his name from his current house to his parents or another owner or dispose off that flat and use the proceeds to purchase a smaller unit for his parents. I have experienced dealing with such scenario and often managed to come out with solutions that is agreeable and acceptable to all parties involved though it may not be ideal.
