I am a Singapore Citizen over 35 years old , Single parent with young twins daughters (2 generations). My current EM HDB is under Joint Account with my Singapore Citizen Brother above 35 years old under Sibling Scheme for the past 11 years since 2009 purchased. My brother would like to retract his name from the HDB and wants to buy a HDB outside and is looking around near Bukit Gombak / Bukit Batok. He has one Malaysia property and in the process of selling it but no buyer yet due to pandemic but trying by few Malaysian agents. Please advise on the procedure and we would like help or services from Agency on this issue. Appreciate it. Many Thanks!

In your brother case, you should not be too worried on the issue of your brother owning overseas property and have no luck finding a buyer right now. This is because HDB rules state that you are only required to dispose off your overseas property within 6 months after buying a resale. You may proceed with the necessary procedures meanwhile and even if your brother fail to meet the timeframe of 6 months after buying a resale, you can always appeal to HDB which practises high leniency in these extraordinary times. However what you should be more concern of is your brother eligibility to apply for a first timer grant. Under HDB rules, your brother is only eligible for first timer grant if you dispose of your private or overseas property more than 30 months ago. In order for your brother to "exit" from the HDB, there are 2 things to take note of:

1) refund whatever CPF monies that he had utilized for the flat, plus accrued interest.

2) you have to undertake the outstanding loan for the flat, subjected to your loan eligibility.
