Hi, my husband and I are going through divorce and the final judgement will be in another 6 months. Our EC has reached MOP. If my husband doesn't want to sell this EC, does HDB allows us to hold on to this EC even after we have been divorce? I understand EC is a private property but still under HDB regulation. Will HDB request us to sell our EC after we have reach final judgement?

Good morning Rycelyn,

I am sorry about your ongoing situation.

After attaining MOP, It is like a private property just that foreigner is not eligible to buy. Thus if you wish to sell this EC, do include it inside the final judgement/ court order if not you will not be eligible to sell without your husband's approval (need his signature on OTP as well).

Sorry to hear about the unfortunate news, I hope you are managing well. As the EC has reached MOP, it is possible for your husband to keep the EC on his sole name, provided he is able to finance the property on his sole name.

He will have to purchase over your share of the property ownership and pay the relevant stamp duties, and also refund the CPF utilized + accrued interest you have used for the current property. If there is still a home loan, he needs to be able to take over the outstanding loan on his income. This is one of the options and you guys will have to discuss the best option on how to deal with the property.

As you have met the MOP of your EC, it is considered as a private property. HDB will not require you to sell it off.

If there is a dispute between both of you, I suggest you put up to your divorce lawyer, to include the sale of the property in the Final Judgement.

Hi Rycelyn,

1) Since your EC already met MOP, this is considered as a private property to SC & SPR.
2) HDB will not have any jurisdiction over whether you can keep it after your life event.
3) If your husband wished to keep the EC he will have to buy over your share according to the market rate.
4) If you are worrying that your husband is unable to afford to pay up your share. You can raise this to your lawyer that in the event he is unable to afford your share, this EC must be put up to the market to sell it off so that you can have your share paid off.
