Hi, my current flat is under joint tenancy with my mother. I'm looking to get a resale EC. I understand I need to remove my name from the current flat, how do I go about doing it? And when my name is removed, can my mother keep the flat (fully paid)?

Hi,

1) Removing or adding a name from a property is not a simple legal process.
2) There could be a buy and sell process, especially dealing with HDB flat.
3) Eligibility: Your mother has to meet the eligibility criteria listed by HDB. She must be an SC above 35 years old. If she is a PR, she will not be eligible to own alone.
4) If your CPF was utilized in this flat. You have to return the used amount + accrued interest to CPF using cash or from your mother's CPF OA. This is the minimum requirement in a normal buy and sells process.
5) If her CPF OA does not has sufficient to return to your CPF OA, she must have the capacity to receive a loan from either HDB or bank to do so.
6) If both CPF OA and loan are not an option, you will have to appeal to HDB and CPF in order to remove your name without returning the utilized amount used in CPF OA.
7) If you didn't contribute any amount to the flat, and your mother alone meets the eligibility criteria. You just need to log into MYHDB using singpass to put up a request to remove your name with reason.
8) If all the above assumptions didn't match your current situation. The last resort is to sell the current flat. You and your mother buy separately.

Hi,

Transferring of ownership requires HDB approval, and the remaining owner to be eligible to keep under their own name (under HDB eligibility scheme), as well as financially able to do so. She also needs to refund the CPF utilized + accrued interest of the outgoing owner.

Unless both you and your Mother are SPRs, you DO NOT need to remove your names from the HDB flat if you were to purchase a resale EC that the previous owners had already met the MOP.
