Hi, have a question on ABSD remission.

My wife and I (both SC) each own 1 private condominium (not EC). We intend to sell off our existing properties to jointly purchase 1 private property. I have read the ABSD eligibility criteria on the IRAS website and understood that I ABSD is refundable if existing properties were sold within 6 months of purchase of new property.

I would like to check in such a situation like ours, are we required to pay the ABSD upfront first then apply for refund? Or we only pay the ABSD if we do not manage to sell the existing property(ies) within 6 months?

Kindly advise.

Hi Chris,

It will be refundable if you sell your existing properties within 6 months of getting your new unit.

Thus, it will mean you need to pay the ABSD first then get refunded after u sold your existing property.

Hi Chris,

For your case, you will not be eligible for the ABSD remission because to be eligible, both of you will need to satisfy the criteria of having own a matrimonial property together as your current property. Even if you are eligible for the remission, you will also need to pay the ABSD upfront first and then apply for refund if you manage to sell off the existing property within the 6 months.

For your situation, I would suggest timing the sale and pruchase together and concurrently so as to avoid paying the ABSD altogether.

Hi Chris,

Thanks for sharing about your case details. I am making some assumptions based on the limited details shared. Based on prevailing regulations and in this case, if you purchase the next property on your joint names as a married couple as a matrimonial property, the ABSD outlay is payable first. And as you may have already know, the ABSD refund is possible if you sell both of your current properties within 6 months of date of purchase of next property or, TOP/CSC of next property (whichever the earlier).

In any case, it would be advisable to sell off the current 2 properties first or at least have some progress as the resale market is generally slower and prices subdued. Unless the next property is pretty unique which is hard to come by.

It would be ideal if I could understand your situation further so to structure the best tailored approach.

Based on your description, you will only qualify for ABSD refund should the property that you're planning to purchase is being held jointly, and that both the properties you and your wife owns, will have to be transferred out latest within 6 months (upon exercise of OTP for resale property, or TOP date for BUC projects) of the property you're planning to purchase.

ABSD will have to be paid upfront first, and then be refunded after you have qualified for the refund.

Good day sir / madam .

Officially , You are not entitled to for ABSD refund because you and your spouse , presently own more then one property , and these property are not jointly own matrimonial property.

You can appeal and request to IRAS , BEFORE you make any joint matrimonial home purchase commitment , there is a possibility that you can claim back your ABSD payable , if you and your spouse successfully sell off your present 2 properties within 6 months , please note , to get a official black and white reply from IRAS to safeguard and claim back your ABSD , in other words , a phone call enquiry to IRAS is not good enough .

Alternatively, you can consider a more straightforward, sell everything off before buying , therefore no need to pay ABSD at all , it has the added benefits of easier cash flow , easier loan financing and no pressure of forfeiting your ABSD paid , interim accommodation can be negotiated with the buyer of your present home , meaning sale of the house include 3 to 6 months extension stay for your family after sales completion , this extension stay for your family to have the time to buy a home and renovation time too.
