Hi Guru, I have these query and would greatly appreciate your input:

My husband and I have 2 properties under our name. Both Singaporean. We would like to decouple both units to under my name only so that he is free to purchase one with a fresh loan.

1st property have 800k loan outstanding and 2nd property have 400k loan outstanding. Assuming that no CPF have been used for the purchase. Can I assume the responsibility for both housing loan? Not sure how much cash outlay do I need to do this decoupling.

Hi Joey,

It depends on how much loan financing you can get, which in turn determines how much cash you need to come up with. Do note that stamp duties apply as well for the share transferred.

Evening,

If none of your either properties involve HDB, the next concern will be if you can perform the decoupling from your partner with the property given to you as "GIFT", since you have indicated that CPF have not being utilized.
Next thing that you have to note is how much loan you will need to undertake for both properties should the first option fail.
Lastly, you will need to know that you will be liable for ABSD of 7%.

You can decouple both the properties, the process will be sale and purchase. It includes
- legal fee
- stamp duty & ABSD
- refinancing of the properties

As per your plans ,

Stamp duty is payable for the market value that is being bought over during the de-coupling process for the two properties.

In addition , ABSD additional buyer stamp duty is payable on the part share that is being bought over because it is a 2nd property .

As per your plans , How much cash you need will depend on the how much the shortfall will be if the bank cannot lend you the entire loan , which is subject to your age and income , please note your husband cannot get a mortage loan on any property that he does not own .

To avoid ABSD , you and your spouse can consider selling both your present property , thereafter , concurrently both of you can each buy a property individually, therefore NO ABSD payable .
