Hi, can I check if buyer has agreed to a 3 month extension for the seller, now seller is asking for another month deferment from the agreed HDB completion date, what happens if buyer does not want to grant the deferment? What is at stake for the buyer?

Hi,

1) The HDB only allowed this special extension stay for 3 months, any period longer is strictly not allowed.
2) Therefore it is illegal to have any more extension than the given 3 mths.
3) Buyers are supposed to occupy the flat after the 3 months extension as this is when the MOP starts.
4) If there is any more extension stay by the seller without the knowledge of the HDB, both the buyers and the sellers are to bear the repercussion from the HDB.
5) However, under the current covid period. There are a lot of delays in the new development both in the private sector and the public sector.
6) If your sellers are unable to leave due to the above reason, they could appeal to the HDB to have an additional stay.
7) Moreover having a rental place in the current market is also very difficult, as the supply is lower than the demand. The rental market is very hot at the moment.
8) Suggest understanding what is going on with the seller and discuss to have a win-win situation rather than to throw them out on the street.

The maximum duration for extension is 3 months upon legal completion. The Buyer will have to take possession of the flat, and cannot rent it out. MOP starts from the day the Buyer takes possession of the flat.
