Hello, I entered a rental agreement with my landlord a little over a year ago (25 Sept 2016). The contract says the minimum stay is 3 months and I have fulfilled that.

On 4th Dec I gave my landlord my notice due to personal issue, and she said she needs 30 days notice period and we agreed the moving out date is 4th Jan.

I offered her to pay the rent on pro rata basis from 25th Dec to 4th of Jan (because I already paid rent on 25th Nov). She agreed.

I asked her about the deposit, she said she can use it to offset the rent. So I thought it'd be the deposit minus the pro rata rent, but she said she'll deduct the full rent.

I'm not sure if this is right and kindly assist me in this matter.

Hi,

You are right this sound abnormal. Since it is agreed to be pro rata, then it should be a sum agreed upon, and not the full month rent.

Deposit is not use for rental deduction which is also a standard clause in most of the TA.

Thus you should pay the Pro rata amount. And request for the deposit refund accordingly.
