HDB Resale Buying. I am married with a son. If I were to buy a resale flat can I just put my name as owner and spouse as occupier? Does she has to sign any doc for the whole resale transaction?

Hi,

1) Eligibility:
To start with an HDB purchase, you will have to ensure you fit the HDB criteria of owning a flat.
There must an SC or 2x PR couple (both have to hold this residential status for min 3 yrs) to be eligible.

2) Method of holding the property:
You may decide how to hold the title of the property. There is no restriction on how many owners in owning a property.
You can be the sole owner and list your child & spouse as an occupier. Since there is no ownership of the property, your spouse does not need to sign any document.
However, she will automatically be the essential occupier as a married spouse. You will have to get her consent if you decide to sell in the future.

3) Finance:
You have to consider how to manage this; HDB loan (2.6%) or Bank loan (1.4x%).
The current interest rate from banks is really attractive now. However, you will have to fork out 5% cash and 20% CPF and/or cash. Since the bank can only loan 75%.
HDB loan on the other hand is more friendly in assisting you to own a flat. HDB loan can go up to 90%, you just need to prepare 10% cash and/or CPF.

4) Grant:
There are various grants available that could assist you further. Please see the grants available here:

Last is to suggest you negotiate carefully with the seller to avoid paying hefty COV. This is getting more and more common in current HDB resale.

Hi Sir,

Yes, you can purchase a HDB resale flat under your sole name, with your Wife as the essential occupier.

Do take note that loan will be on your sole income, and MOP applies for both owner and occupier. This means that both need to sell off all owned private residential properties (local and overseas) within 6 months upon the HDB flat purchase, and to serve the 5-year MOP before being able to purchase another residential property.
