Currently I am staying in a 5-room BTO flat in Woodlands . Flat was purchased on 27 Jan 2016. I am the co-owner. My 11-years old daughter is the Authorised Occupier. I have left with $205,322 to pay for the flat.

I am planning to get marry to a foreigner soon. We are interested to purchase a landed property or an apartment in Woodlands.

Pls advise the following:
1) I would like to rent my flat and also purchase a landed property or an apartment
2) What is the difference in costing in purchasing a landed property or an apartment if
- My foreigner husband bought it himself
- My foreigner husband and me bought it

Hi Mdm ND,

1) Your foreign husband is not eligible to purchase landed property. He also cannot be an owner of the landed property.
2) Thus if he has to be an owner in order to apply for a mortgage loan, your only choice would be an apartment (non-landed property).

3) The cost will be as follow:
(a) Foreigner buy alone or buy with you (while holding to current flat) - subject to 20% ABSD.
(b) If sell away the current flat, buy with a foreigner husband can declare as a matrimonial home - no ABSD.

4) Do note that sequence of selling and buying is crucial, buy after selling the current flat then will not be subject to ABSD

Hi,

Unfortunately foreigners cannot purchase landed property in Singapore and only you as Singaporean can purchase as a owner.
An apartment may be a better option, as he can purchase as a foreigner. The main difference is the stamp duties payable. For you purchasing as a 2nd residential property, the ABSD is 12%. Whereas as a foreigner owner, his ABSD is 20%. If jointly purchased, the higher of the two ABSD is applicable.

Hi ND,

To rent out the flat, you'll HDB approval. However, it will be counted as one property count for you.
There is limited strata landed property that foreigner can buy, ABSD is 20%. It also depends if the nationality of the foreigner is under FTA.
If both of you buy as matrimonial home, you can apply for ABSD remission if you sell your current HDB within 6 months from the date of purchase.
Timeline planning is a key factor too.

Hi ND,

Should you decide to purchase a landed property, it has to be under your sole name, as your foreigner husband is not able to own a landed property in Singapore.

Should you purchase a non-landed private property together with your foreign husband, ABSD of 20% is applicable if he is not from one of these countries: Switzerland, Norway, USA, Iceland, Liechtenstein.

Do take note that if the property is purchase under both your names, LTV is also capped at 45% as your current HDB flat is still under loan. If it's purchase under his sole name, then LTV would be 75%.
