A Singapore court has thrown out an appeal filed by a group of consenting owners on the proposed S$33 million collective sale of Harbour View Gardens (pictured) in Pasir Panjang Road, media reports said.
The decision upholds a previous High Court ruling by Justice Belinda Ang in April, which found that the property’s collective sales committee “had not acted in good faith” and the conduct of its marketing agent was “commercially unacceptable”.
The appeal was mounted by the majority owners, represented by Drew & Napier senior counsel Hri Kumar.
The freehold Harbour View Gardens comprises 14 three-storey walk-up apartments. It was sold to a unit of Roxy-Pacific Holdings last July, with Colliers International appointed as its marketing agent.
Parties involved in the sale declined to comment on the appeal’s rejection. Meanwhile, the court is yet to release a written judgement detailing the reason for the dismissal.
