I'm a co-owner of a resale HDB flat with my single parent. I am about to get married to someone who is also a co-owner of an HDB flat with her parents. Once we are married, we plan for her to come stay with me. We know it means she will have to remove her name from her parents' property for her to reside with me in my resale property.

My question(s):
a) Does she need to add her name as co-owner of my current resale property after marriage?
b) If "no", can I continue with the current mortgage loan that I have?
c) If "yes", how will that affect the current mortgage loan for my resale property?

Hi, she does not need to add her name as Co owner of the property, however in the future when you plan to dispose of the unit , it may require her approval . The mortgage loan should be able to proceed as normal and nothing will change, of course it is best to check with HDB.

As married couple, they can only own 1 HDB property between them, therefore either of you will likely have to give up the ownership in the respective flat.

The key concern is always about what happen to your parent or her parents? Are they able to retain the HDB on their own in terms of eligibility (age, citizenship) as well as financially (refund of CPF funds plus accrued interest to the exiting co-owner). These are questions you will need to be able to work out with your partner to look into the most suitable options. Perhaps an appeal to HDB may work but let's not rely on that in case if appeal is rejected.

Hi,

a) Your future spouse is not necessarily to be a co-owner of your current flat after marriage.
But, as a married couple, the HDB is treated as a single entity instead of 2. So, one of you has to give up ownership of an HDB flat.
b) After marriage, your spouse can be an essential occupier instead of a co-owner. There are no changes to the current mortgage loan.
c) If your spouse wanted to be a co-owner of the current flat. You will have to go through the part-share selling process.
There are 2 options to do so:
(i) Selling without profit: Meaning your spouse will be taking over the share by returning the CPF funds with accrued interest on the share value.
(ii) Selling with profit: This means you depart your share according to the current market value.

Option (i), you have to get the HDB to assist you in the whole process.
Option (ii), some property agents are aware of how the process works if the HDB does not help.

1) I think the main concern is whether your future in-laws have the financial capacity to take over your future spouse's share.
The option (i) & (ii) is also applicable to her situation.

2) The takeover party can apply for a loan to assist them in the taking over process if eligible.
