I and my fiance signed the contract to purchase HDB unit but our marriage will not be happened due to family problem. In this case, we are no longer eligible to go ahead the HDB purchase and we have to cancel the contract. In this case, can the seller do any legal action to us and how will the process be for deposit paid?

Hi Emily,

You can back out if you haven't exercised the OTP. Even you have exercised then the seller got the right to take legal action again you. However in most cases, the seller will just forfeit the money and move on to find the new buyer.

Afternoon,

If you have exercised the OTP, the seller have the legal rights to claim compensation or request for specific performance. Hence it would be prudent that you consult your agent accordingly.
