I am buying a resale condo and the seller request 6 months free extension. I know for HDB the maximum is 3 months. Does this also apply to condo? And if during the extension the seller doesn't maintain good condition or carry out some structure works (the letter of extension stay states seller should not do such things), can I terminate the extension immediately?

Hi Harold, if you allow extension in the first place, then you can’t back off once the completion is over. So it be difficult for you during that 6 months should any dispute arises.

For duration of extension stay, it is part of the terms during the negotiation process.
If one has agreed on the terms (such as duration of extension stay or option fees payable), it formed part of the contract.
Both parties have to adhere to the terms and conditions of the contract. While 6 months free extension might feel too long, if it had been agreed upon and signed, then, there is little can be done.
During the extension seller is required to maintain the property and not do structure work.
Tenants has exclusive possession of the premises, meaning one are not allowed to come into the premises unannounced or without permission. Hence, it is hard for one to verify whether there is any works being done during the extension period.
However, after the seller move out and if the buyer find that the place is not in its original conditions, the buyer can seek legal means to restore the property back to its original condition. One can terminate the extension if one can proof without breaking the law by entering the premises legally .

For private, I wouldn't call it an "extension of stay". It's more like a "sell and lease back" agreement, that is tied down by the initial OTP. In such cases, if both parties agree to the terms, it will be valid.

I had recently acted for the Seller in such a scenario, whereby my Sellers has the option to rent back the property upon legal completion for the next 3 months, subject to a rent payable to the new Owner.

I believe you have the answer. The 6 months free extension you have described forms part of the conditions of sale. This is a private residential resale transaction therefore it considered a private treaty where both seller and buyer must be agreeable to all the terms and conditions, before the Option To Purchase is issued. I had 1 case a couple of years back where the extension stay for free was for 12 months.

you should price it into your purchase price...to cover the 'loss' of use or rental.
