Hi,

Me and my partner had divorce recently.We have 1 kid. We have come to a conclusion and decided by the court that we would sell our flat and divide accordingly as agreed.

1) We bought our 4rm flat on Oct 2017 at $299,970 in Punggol as a 1st time buyer. Understand that the flat has not met the MOP but the court order stated that we would sell the flat at open market subject to HDB approval.

2) What is the process for us as a start? Do we need a agent or we can go direct to HDB?

3) What are the chances that we are able to sell our flat to open market? What if we have to surrender instead of selling what will be the compensation be like or are there any extra charges?

4) If not, what are the other options? We have agreed to a sum of 30/80. And im wondering what is the amount we will get if; a) Sold to open market
b) Surrender to hdb

Dear Sir/Mdm,

I have personally handled a number of such cases before and will be happy to give you an overview of the process and highlight the issues to look out for.

Since the court order is out, although you have not fulfilled the MOP, you will need to write in to HDB to seek for a waiver to sell within the MOP before you can kickstart the sale process.

HDB no longer buy back the unit and therefore you will need to sell in the open market and by doing so, you will be able to get a much higher price as compared to the buyback price which HDB is offering.

I will recommend that you get an experienced salesperson to assist you so that you can get a good price for your property.

For divorce or sale of flat before MOP, you have to inform HDB in writing or visit HDB office 1st to notify intention and get approval. Otherwise, you can't even file Intent to Sell.

For selling part, it's advisable to engage an experienced agent who is familiar with your area. Process is not straight forward like most DIY Buyer case.
