Hi, I am having a massive headache now. Future spouse co-owns a private property with her sibling and still servicing bank loan. Is it possible to transfer the ownership to her sibling and apply for a resale flat with myself (and receiving government grants)? Is this wise and what are the costs involved if holding period of her private property is >3 years?

Hi,

Its possible to sell away her share of ownership to her sibling, assuming the sibling is able to finance the home loan by his/her sole income and is able to refund the CPF utilized by your future spouse.

May I know when did they purchase the private property? As seller's stamp duty may apply.

It may not be the most ideal move, as you may not be able to receive first timer housing grants for the hdb. One of the conditions is the applicant can't be a private property owner within the last 30 months to be eligible for the first timer housing grant. There are also income ceiling for the grants as well.

Hi,

1) Yes, it is possible to transfer the ownership to her sibling.
2) Do note SSD might apply depending on when this private property was bought, on and before 2017 Mar 10th, is 4 years SSD, on and after 2017 Mar 11th, are 3 years SSD.
3) Your future spouse sibling also must have the financial means to take over the mortgage and pay the shares from your future spouse, buyer stamp duty, etc.
4) There is a clause on grants application that might be missed by lots of people who owns private property:
"Do not own other property locally or overseas, and have not disposed of any within the last 30 months"
5) Whether it is wise has to depend on what and where did she bought it. It is not possible to guess from here.

Hi Sir,

Your fiancee can transfer her shares of her private property to her sibling, provided that her sibling is able to support the remaining loan of the property, and also refund the CPF monies (plus accrued interests) that she had utilised for the property.

The cost of transfer would be the legal conveyancing fees (on both sides), and the Stamp Duties (BSD/ABSD/SSD whichever applicable) on the share value of the property being transferred.

Both of you can then proceed to purchase a resale HDB flat under Fiance/Fiancee Scheme or Public Scheme if married. Do take note that in order to be eligible for the Housing Grants, she will need to dispose off her shares in the private property, and then wait out a 30-month period. Both of you must also match all other eligibility conditions (i.e income ceiling etc).
