Sorry, but long post ahead.
Need an advice on a matter.
Last year my fil passed away. He was the sole owner of his flat as my mil passed away 10 yrs ago. He willed the house to his nephew(just turned 21 this year in January n currently in NS, 1 year more to ord).
This nephew have lived with them since a newborn. He was an unplanned pregnancy by fil's sister hence the mum gave him to Fil n Mil fresh out of the hospital n is out if the picture but they did not legally adopt him. Nephew is the remaining occupier of the flat.
So this house is not paid off n has 90k more to go which my fil stopped paying for 5 yrs since he fell terminally ill but somehow HDB has been kind to just let him hold on the flat till his death. They did not take HPS.. Sigh
So now the question is, is there a way for nephew to retain the flat. What are the chances?
Options the case officer gave is.
He will give estate managers (executors) a 1 year period to sell or raise the 90k but if we don't do both. When the nephew ord in November, he finds a job. Anything which pays $1.4k above n with the 3 months cpf contribution apply for HLE.. if HLE is approved, continue with the payment plan n acquire the flat. But if HLE is not approve, no choice but to sell the flat. Do note he is also not an immediate family member as such it is subject to approval(up to the approving team)whether they approve the transfer of ownership of the flat anot. But for all this matters the case worker can't even let us know the chances. His reply is "see how", n he seem like a pretty bo chup officer.
We called the HDB customer service to ask regarding this situation. Customer service said not possible especially his birth mother is still alive and he is below 35 yrs old, he does not meet the HDB eligibility criteria to own a HDB flat.. sigh. And for the HLE given his age 21 yrs old with no CPF n savings n with flat being 42 yrs old.. he will not be given 90k loan but 40k. So remaining 50k have to come out in cash.
Have anyone faced a similar situation?.. care to share pls. Can the flat be finally acquired by nephew?.. because we don't want to waste 1.5yrs n at the 11th hour scramble for a buyer for the flat n moreover the flat is 42yrs old n a depreciating asset. What I understand is the maximum extension is 2yrs to estate manage.
