Upon exercising the Option To Purchase, both sellers and buyers have entered into a legal binding relationship to complete the transaction. In HDB resale transaction, only HDB has the authority to disapprove the transaction where all monies paid (Option Fees and Option Exercise Fees) to the seller must be returned to the buyer. Otherwise, the "suffering party" can claim damages against the others and it will greatly depends on the extent of issue in terms of what is being claimed. It is advisable to settle this amicably between all parties instead of going through the legal channels to reduce inconveniences and costs.
