This question is related to inheriting a private property in Singapore for a Singapore citizen.
1) Is seller stamp duty applicable if an inherited private property is sold off within 3 years of inheriting the property?
2) I understand I need to fulfill MOP if I own a HDB. If I do not fulfill MOP & want to inherit the private property, what are the options available to me? Can I appeal to HDB?

Good afternoon,

If you inherited a residential property via a valid will, the Intestate Succession Act, or the Administration of Muslim Law Act, and the property was acquired by the deceased more than 3 years ago, generally there is no Seller's Stamp Duty applicable.

If it was inherited when you are still serving the MOP of the current HDB flat, you will have to appeal to the HDB Branch on whether you are eligible to keep this private property.

Hi Sir/Mdm,

1) It depends on the purchase date of the inherited property. If the property is purchased more than 3 years ago then the seller stamp duty is not applicable.

2) if you are still within MOP, you will still be able to inherit the private property but you will need to seek permission from the HDB.

By the way, if the deceased own the private property for more than 3 years, then stamp duty is not applicable in this case. As for the HDB side, you just have to appeal and submit all relevant document and approval will be on a case to case basis.

Hi,

1) Seller stamp duty is only applicable to the first 3 years to the buyer and not from the inheritance.
2) You can only appeal to the HDB to keep your inheritance if you are still within the MOP. They are the only ones who are stopping you from keeping your inheritance.
