Owner has breached the contract , however owner refuse to compensate, the reason is the TA didn't state that if she breach contract she need to pay compensation,can she use this reason to refuse to pay compensation ?

Afternoon,

It would be good that you contact your servicing agent or lawyer who drafted the TA and seek clarification. A properly drafted TA should cover the essential pointers.
