My wife & I currently own an EC. Our EC TOP is in Dec 2016 so 5yrs MOP will end in Dec'21. But we collected our keys in Mar 2017.
If we intend to decouple, can we do so after 5 yrs MOP (Dec'21) or only after 5yrs from key collection (Mar'22)?
Also when decoupling, must buyer pay ABSD on the seller portion?

Hi,

The decoupling can be done once 5 years MOP are met, and this 5 years MOP counts from the date the EC officially attains the TOP, in Dec 2021 for your case. For the share ownership purchased, BSD is applicable. You also need to be able to refund the CPF utilized+accrued interest of the outgoing owner and the remaining owner must be able to service the loan on their own income (subject to bank approval).

Hi Sir,

Yes, you can decouple once you have met the MOP of your EC, in this case, Dec 2021.

Stamp duties (BSD/ABSD) is applicable on the percentage of shares to be transferred. If the Purchaser is a SPR, ABSD of 5% is applicable on the shares transferred.

Dear Sir,

For EC, there is only 1 MOP date for the whole development regardless of when you collected the keys. Likely your MOP will end in Dec but I can double check for you.

Upon MOP, you may do the decoupling. ABSD is not liable but there will be normal buyer stamp duty for the party who is taking over from the exiting party. There is also legal fees involved as well.

Hi,

1) Good question, this was not stated anywhere on the HDB website.
2) So far those cases I've come across are using TOP as the start date to calculate MOP to do decoupling to purchase private property.
3) Because EC before 5 yrs MOP is still under HDB, you may log in to your MYHDB to check your MOP using Singpass if you are unsure.
4) As for HDB flat inclusive of DBSS, the computation of MOP is started from the date they collected their keys.
5) So you may do your decoupling on Mar 22.
6) ABSD is based on the count of property. If this is the only property that buyer owns, he/she will not subject to ABSD. Because after purchase of the part share, he/she still considered owning only 1 property.
7) I would suggest you do your finance carefully before rush into it. Any cash that needs to pay to the seller has to be available. It is not just a left pocket to the right pocket scenario. A cashier order has to present to the seller's lawyer before this transaction can proceed.
