My husband: Singapore citizen. Myself: PR.
My husband has joined name with his sister of private property and we get married after that. He is still the owner of the Private house. May I buy a HDB or BTO alone if I am married without owning any hdb flat?

Hi,

Unfortunately no, for hdb purchase you will need to purchase with your spouse as a married entity family nucleus, meaning he has to remove his private property ownership.

You can purchase resale EC or condo on your sole name no issue. Hope the above clarifies. May I have more info and requirements about your plans so as to make better recommendations? Thanks and look forward to value-add to your housing plans.

I would like to compliment Mr Ivan Ng for his professional work and effort.I sent my first post in Jan 2019 and Ivan replied promptly, so I have decided to contact Ivan for follow up. My EC was not ready for sale due to MOP (another 3 months from Jan) at that time and Ivan was able to give me advices on how to proceed from there. Initially we have decided to try to write to HDB for early sale but since it was only 3 months left, eventually we waited for another 3 months while we looked for our next property. Dear madam,

I am sorry to inform you that you are ineligible to purchase any HDB on your own since you are married, without having your husband dispose off his ownership of the private property he is currently owning with his sister. As what Ivan has indicated in his earlier reply, both your husband and yourself are considered 1 entity under the HDB's perspective this is the requirement.

Your husband may wish to discuss with his sister on having the sister takeover sole ownership of the private property?

Hi Mdm,

Since you are married, you will need to include your husband as an owner or an essential occupier if you were to purchase a HDB flat or BTO flat. By doing so, he will need to dispose off his share of the private property within 6 months if you purchase a HDB resale flat. If it is a BTO, he will need to dispose off his share and wait out a 30 months period before you can apply for a BTO flat.

Yes, you can purchase a HDB resale flat with your Husband as the essential occupier.

However, being an essential occupier, he will be required to dispose off all properties (local and overseas) latest within 6 months from your HDB purchase. Both of you will also be required to serve a 5-year MOP before you can purchase another property.

Hi,

1) When coming to buy a resale HDB flat, a married couple must submit both their names for the application.
2) It can be 1x owner + 1x occupier or 2x owners, but both names have to be submitted.
3) The requirement after buying the HDB flat is both cannot have any interest in a private residential property locally and overseas.
4) So your husband can dispose of his interest to his sister after the purchase.
5) In order to be eligible for a BTO, the married couple cannot own any private residential property for the past 30 months.
6) Therefore your husband must dispose of his interest in the current private property for 30 months before both of you are eligible to submit an application.
