I'm seller of HDB flat. I appointed an agent to handle the sale for me due to oversea. And my HDB got UML case before and i had declared all the facts to the agent with all police letter proved is closed. after one month later, the agent got me a buyer and paid the 1k deposit and 4K subsequently to exercised the otp. but just before we both need to submit resale application to HDB recently, buyer claimed that they aren't aware the UML case during their viewing nor after they exercised. Now they don't want to continue buying and want to back out and asking the total 5k to be returned. As what i know is after OTP signed and exercised is already legal biding contract. ME as seller can't back out furthermore, all viewings is conducted by the agent, i had declared facts beforehand. now the buyer threatening to get lawyer to sue me for the deposit. but i feel nothing wrong on myself, two month has been spent and my outbound ticket booked to facilitate the completion. Any idea for me to carry on.thx

Hi, you have declared everything truthfully and you are not in the wrong either. And as a matter of fact, you could counter sue the buyer too if they don’t want to complete the whole sales process. At the point of time. I would suggest that you just liaise with the HDB officer in charge of your case and also to consult a legal firm on what’s your next course of action. Dear owner,

Exercising the Option To Purchase puts both sellers and buyers into legal binding situation to complete the transaction, unless the resale application is rejected by the HDB due to proper reasons like ineligibility to purchase or sell.

As Aaron has mentioned, in such scenario, should buyer decide to back out of transaction, you have every right to seek damages via proper legal channel and express your stand to the purchaser progress from there. The above is 1 option you can take potentially, however, the setback of this option is that the legal option can be a long affair before anything is settled.

The 2nd option is to move on from this buyer and look for another purchaser who is willing to accept the UML issue and complete the transaction.

In handling such matters, there are always at least 2 options, the legal means and the practical means. Not taking the legal means doesn't mean you are wrong but simply because this option can be extremely draining and dragging.
