If in the middle of the tenancy, I realize my tenant is too dirty, and I want her to leave. Can I ask her to leave? If I want to ask tenant to leave I just have to give one month notice and return her the deposit right? Does it make a difference whether she's the tenant who sign the contract or just an occupant in the TA?

Hi,

There are few queries from your post. I'll split them out to answer one-by-one to help you to straighten your thought.

1) Remove tenant/occupier in the middle of tenancy.
Some of the tenancy contract has a clause stating a minimum period of stay, and allow early termination of TA.
You may request tenant to leave with one month notice if your TA include this clause.

2) One month notice and return deposit.
Please refer to (1), and yes, can give one month notice for tenant/occupier to leave according to TA.
You may request tenant/occupier to clean up the place before handover, or deduct the cleaning fees using professional cleaner from the deposit if there is a clause on returning premise as per takeover.

3) If your TA does not has the above 2 clauses:
(a) Early Termination
(b) Cleaning condition
For (a), has to go into a negotiation process and sign on separate agreement to deal with this.
For (b), same as above. Otherwise it is just handover in a reasonable cleaning condition such as sweeping and mopping up the place.

4) Both principal tenant and occupant suppose to keep the premise in a "reasonable" condition. Therefore the term "reasonable" is a subjective term that always has room of discussion.

We are all civilized people, so try to solve the matter that both parties can accept. There are no perfect solution thus it is good if you can get a 3rd party to come into discussion rather to get into emotion discussion.
