I bought a resale flat in 2002 whilst still a single using my sister's name as co owner. I got married in 2008, and in Dec 2010, I bought over my sister's share of the flat as a sole owner. I understand that the repurchase of my sister's share is considered as a new resale purchase transaction and I fell under the 5yrs MOP which expires in Dec 2015. However, in Sep 2012, my application for rental of whole unit was approved by HDB, to which I did rent out my flat and I paid for the increament in property tax. However, I was not allowed to sell my flat only until I fulfilled the MOP of 5yrs. My question is, why did HDB approved my whole unit rental even before my MOP expires and yet doesn't allow me to sell my flat before the MOP expires?

Morning Ismail,

Firstly, I'm not sure how did you managed to buy over your sister's share without the need to add your husband as essential occuiper, if he is a foreigner or co-owner if your husband is PR or SC.

Secondly, being SC, if you have special needs to rent out your unit, based on work or personal requirements, HDB have no rights to stop you from renting out the unit. And I believe you requested for it, since you have gotten the approval. By doing this, I'm also sure that you are aware of your liabilities and duties.
