Hi PropertyGuru, I have 2 questions

1) Based on interstate law on HDB, if there are 6 beneficiaries to this HDB flat, however 4 beneficiaries still want to live in their own flats/property, does that mean the 2 beneficiaries who are not owners will be left to inherit the flat? Or still need to split by 6.
2) If the inherited flat is sold by one of the beneficiaries, can this beneficiary who is a bachelor in his late 30s buy a new flat BTO/resale,will it incur additional stamp duty fees? Or be considered a first-timer still. Thanks.

Hi sir

For your first question, all beneficiaries will have the rights to the proceeds from sales of the flat. If there were any beneficiary that wish to retain the flat, they have to meet the requirement to own a flat under one of various HDB schemes for ownership and subject to consent of all the beneficiaries involved. For inherited flat, it does not count towards a subsidised flat and therefore the bachelor concern can still purchase a BTO or resale with CPF grants. No ABSD is applicable as this duty is only payable to those buying a second property without selling their current ones.
