Hi I purchased a property that came with tenancy. I was told by the agent who managed the tenancy that we are not allowed to terminate the tenancy even with ample notice. Is this legally binding? And the rent paid at this newton unit is also very low (the same as suburbs), we are also told that we cannot increase the rental. How is this fair to the owner?

Hi, yes it is legally binding as the Tenancy Agreement was already signed. You got to understand that it must be fair to the current tenant too right? However everything can be negotiated as well. And in most cases, the new owner would try to compensate the tenant and in the hope that the tenant would agreed to accept the compensation and to move out. Dear sir/madam,

You should have considered all these aspects when you purchased the property with tenancy. I am curious why would you think that it is alright to give sufficient notice period for the tenant to move out since there was a tenancy agreement signed between the last owner and current tenants? Unless there is clause(s) that allows premature termination of the tenancy agreement, this contract signed is legal binding and should have been sent for e-stamping.
