Hi,
I’m 44 stay home mum, married for 11 years and getting a divorce. Currently staying in a condo with husband and daughter. Husband agree to give me all the proceeds from selling the condo including his cpf fund so that I can fully payoff a hdb as I’m not working and even I work I will have problem taking a loan.

I would like to know after divorce and sold off the condo, will I be able to buy a hdb flat under ASSIST scheme immediately? Do I still have to go thru the 15 month waiting period?

Hi, you may still have to go through the 15 months waiting period as the ASSIST schemes is a priority scheme that gives you additional chances of getting a flat for BTO. However, you can call in to HDB to check with them on this. As for the refund of CPF fund, I am not sure if it is possible for his CPF funds to be given to you, unless the court order states that all the proceeds goes to you.

Hi,

Unfortunately as of prevailing regulations, there is still a need to wait out 15 months after the sale completion of condo. We can try to appeal with hdb again once the final judgement court order is out, they may be able to help based on unique circumstances, although its on case by case basis approval.

Sorry to hear about the situation. Under such circumstances, provided you are a Singapore Citizen, you will still need to appeal to HDB for allowing you to purchase a resale HDB after the sale of your condo after the matrimonial split. You may wish to rope in the assistance of your MP for this appeal to waive off the 15 months wait out period.

Do work out the finances clearly to ensure that you are well covered in this instance for the purchase. Whatever proceeds from selling off this condo including his CPF funds cannot be firmed until it is written into the final judgement for him to do so, and not just verbal agreement.

If you are one of the owners in the current condo, unfortunately you will need to fulfill the 15 months waiting period before you are eligible to purchase a HDB flat. However, as the your situation is unfortunate and you will need a roof above your head with your young daughter, I would propose we appeal to HDB to allow you to buy the flat immediately after the sale.
