Hi.
I intend to inherit HDB unit from my late mother and I own 2 private properties. The HDB unit was purchase in 2008, Sole owner demised in 2019.Under the intestate succession act, there are six beneficiaries. Transmission completed.
Query
1. Do I required to pay ADSD on the inherited HDB unit, as I am not the sole beneficiary.
2. If other beneficiaries not eligible to own the HDB unit and willing to give out their share, Can I takeover their share and be the sole beneficiary. Do I need to pat ADSD ?

Good afternoon Mr. Ong,

Since you already own 2 private properties, chances are HDB may not give approval to allow you to inherit and keep the HDB as well, unless you are willing to sell away the private properties. It is likely they will require the property to be sold on the open market and the amounts distributed accordingly to respective beneficiaries. You may want to confirm with HDB on this eligibility to keep the hdb first. I have worked on similar cases and would be happy to share more on the best approach.

Hi Sir
You may take over your mother flat only if you disposed off your 2 private properties. If you choose to take over the flat without selling your 2 private properties, HDB will require you to sell off your 2 private properties within 6 months of your takeover. No ABSD will be incurred since HDB does not recognised dual ownership during HDB MOP period. You can proceed to purchase or invest in another private property only after 5 years (MOP met) from the date you take over your late mom flat. Hi Mr Ong,

Firstly, ABSD is not payable for properties that are inherited.

Secondly, whether you can keep the HDB flat and your existing private properties, will depend on when the HDB flat was bought, and if it was a "subsidized flat".

If the HDB flat was a "non-subsidized" flat bought before 30th August 2010, then you will be able to retain the HDB flat together with your existing properties.

In the event that the flat was a subsidized flat, and you wish to keep the flat, you will be required to dispose off all your private residential properties.
