Hi.

I have two questions
1)the seller have sign possession date on 31 jan, but the seller will move out on end of feb. What does it mean?the date was told by the agent when sign otp and was told the latest date they will move out is on 31 jan

2)the floor plan and the house was not tally, the agent said will bring ppl to inspect the house, but when i check the floor plan, there was a bit difference from the house.

What should i do?

I cannot make out your 1st question, what do you mean the that sign possession date on 31 January but seller will move out on end of February?

You meant to say that you didn’t really check the floor plan or the unit sizes before you even pay the option fee?

Hi Bryan,

1) In general the seller supposed to vacant and handover the unit on completion. I suppose this is an extension agreement signed between you and the seller.
If there is only a verbal agreement then you are at the mercy of the seller.

2) Where did the agent get this floor plan from? Is it from the HDB if this is an HDB flat, or from the developer if this is a private residential unit?
You can only engage a surveyor if you think you are being cheated from this transaction.
You may start by bringing the survey report and the given floor plan and sue the seller and agent to the court that you are being short-changed from this transaction.

3) Again, I would like to urge the buyer really consider to engaging a professional to represent your interest in buying. This is a hundred of thousand transactions, and not buying a bag or just anything else. Most of us are using our life savings and long-term commitment (10~25 yrs) by getting a housing loan. Why take such a risk by saving a few pennies in such a large-sum transaction?
