Hi, I am Renting a house, staying with my family from past 9 months, now i have bought the HDB house and next month i am moving to my own HDB house, when i gave one and half month advance notice to my Owner to vacant the house, he is saying that i can't vacant the house before completion of one year, and he is threating to take legal action against me. but in my agreement there is no such clause indicating that i am not allow to terminate the agreement before completion of one year, BTW i am going to complete 10.5 month before i vacant the house, hence i would like to know my rights, do i have engage the lawyer or what should i do, please advice, thanks in advance

It would be prudent to consult your servicing agent and seek his advice as he would know the details, be it written or verbal, when you have signed the TA.

Dear tenant,

You may also wish to examine the tenancy agreement to see if there is any provision for you to terminate the tenancy agreement prematurely by giving 1.5 month notice to landlord, otherwise the tenancy agreement have stated the lease commencement date and when it expires, meaning there is provision for premature termination. Typically for 1 year lease which I have handled, there is no provision for early termination unless both landlord and tenant agree.

I would encourage you to work out a solution amicably with the landlord instead of going to the lawyer and spend more money to pay the lawyer than the outstanding rental amount which is about 1.5month rent.
