Hi,

I am negotiating a tenancy agreement and the landlord's agent inserted a clause stating that I have to reimburse the Landlord on a pro rated basis in the event of early termination the agent's commission.

I would like to ask if this is legal? I feel that this is unfair as my security deposit would be deducted in the event of early termination already.

Hi Peter, every TA would be slightly different from each other. And as a landlord agent, his interest is gear towards protecting his landlord instead of you. And so it still voice down to negotiating with the landlord agent.

Dear Peter,

As this is a private rental agreement, in order for it to be valid, both landlord and tenant must agree to its content before proceeding further. Salesperson cannot include any terms and conditions unless landlord wants to have these clauses added into the tenancy agreement. Would this be a deal-breaker? Do you have the intentions to terminate this tenancy prematurely such that this clause is of great significance?
