Hi Gurus,

Our EC is reaching the 5-years MOP next year and we intend to transfer the ownership of the EC (fully paid by CPF & bank mortgages) to our 24YO son and apply for a new 2-room-flexi HDB BTO. Some questions need advice from Gurus:
1. Can we apply BTO immediately after transferred the ownership? If no, what is waiting time?
2. Do we subject to any 'seller' taxes if we transfer the EC ownership to our son?
3. Is our son need to 'pay' the market price (incl, CPF & cash) of the EC to us?
3. If our son decides to sell the EC later, is he subject to any 'seller' tax?
4, where the money (incl CPF) goes to after the EC is sold by our son and both of us still alive?

Dear Mr and Mrs Wu,

There will be a sit out period of 30 months before you are able to apply for BTO after relinquishing the ownership of the EC. As you have fulfilled the minimum occupation period of your EC by then, there is no tax applicable for the sale, but there is a stamp duty applicable for your son to be taking over the ownership. The CPF utilised for this EC must also be refunded including the accrued interest. Upon acceptance of this property as a gift, your son will not be allowed to sell this property within a 5 year time frame. Any sales happen thereafter will be cash proceeds in your son's name.

Hi Mr & Mrs Wu,

1) Yes, you can transfer your ownership of your EC to your son, but he will need to refund back the CPF used + accrued interest to you/your wife accordingly.
2) There is a wait-out period of 30months from the effective date of transfer before you can apply for brand new BTO / EC again. Please note that Resale levy is applicable for your next subsidies housing.
3)There is no Seller's Stamp Duty if you sell your unit after 3 years of holding period.. For your son, if in the future he wants to sell, then will be based on his holding period as well..

Dear Sir/Mdm,

1) You will not be able to purchase a new BTO from the HDB within the 30 months from the disposal of the EC. However, you will be able to purchase a resale flat with no restrictions.

2) If you wish to gift it to your son, he will need to pay the normal buyer stamp duties and also need to return you the CPF plus interests that you have used so far.

3) It is advisable to sell the property to your son at market value and he can take a loan to finance the property. Alternatively, you can sell the EC in the open market and use the sales proceeds to allow your son to invest in another property.

4) Seller Stamp Duty is only for the first 3 years. Selling after 3 years will not attract any stamp duties.

5) If your son is the legal owner, all the sales proceeds will go directly to him after the sale.

You need to wait out 30 months after disposing of current property and apply for BTO.
No seller stamp duty however there is buyer stamp duty and the return of CPF plus accured interests that have been used for current home.
No seller stamp duty after 3 years of holding period
All proceeds will go to your sons account as he is the only legal owner for the property.

Afternoon Mr. And Mrs. Wu,

It depends on the 2-room flexi type you are looking at. Assuming its a brand new 99 years lease 2-room flexi, you need to wait out 30 months after transferring the ownership of the private property before you can apply again brand new direct from HDB. Do note there are eligibility conditions to fulfil as well such as income ceiling. More details @

For a transfer of ownership, even by way of gift, the buyers stamp duty is required (based on market value) and the CPF utilized + accrued interest you have used for this property has to be refunded to you by the incoming owner. Will suggest to sell on market value basis so that he can finance it with a bank loan. It also depends on his income profile at the moment. He will be subjected to Sellers Stamp Duty if its sold within the first 3 years after transfer of ownership.

Hi Mr & Mrs Wu,

You can transfer your EC to your son after you have met your 5-year MOP.

However, take note that you will not be able to apply for a 2RM flexi flat immediately thereafter. You will need to wait out a period of 30 months before being able to apply for it. Upon application, you will also have to meet the other eligible conditions, like income ceiling etc.

There is no Seller tax involved as you had already owned the property for more than 3 years. There will be Buyer Stamp Duty imposed on your son though, for his "purchase" of the property.

Your son can opt to "purchase" the property from you at market valuation (or slightly less than that). Should he chose to sell off the property within the next 3 years, SSD will be imposed on his sale.

Upon the sale of the property, the sale proceeds he will get will be from the Sale Price, less off all outstanding loan, less off all CPF refund and other miscellaneous fees (agent fee, legal conveyancing fee etc).

Perhaps you could share with me what's your plans and reasons for making the transfer? Only after fully understanding your plans will I be able to advise if this plan makes any sense.
