Hi Gurus,
Me & my wife are SC and live in a resale HDB-5rm flat (fully paid) since we bought in 2018. Our son who owns a fully-paid pte 2br condo and wants to transfer ownership to me, so that he can apply BTO with his girlfriend. Question: Can I take over the ownership? what are taxes involve?

Hi Mr. Woo,

Unfortunately it can't be transferred to your name, as you are still within the MOP period of 5 years. Also, as he is a private property owner, he has to wait out 30 months after removing the name from the private property before he can apply BTO. Perhaps we can think of alternative solutions if I can have more info?

Your son private property can't br transferrd to you since you have not completed MOP. One other complication is your son might not be able to immediately apply for a BTO even if he sells his 2 bedroom condominium as he has to wait for 30 months period before being able to apply one. He is eligible to purchase a HDB resale together with his fiance however with the condition that he sells off his 2 beeder condo. Hi Mr Woo,

You won't be able to take over the condo as you have not fulfilled your MOP of 5 years. After your MOP, you may take over but you will still be liable for the Additional Buyer Stamp Duty of 12%.

If your son wish to buy a BTO, he will need to dispose off his private property and wait out a 30 months window period before he is eligible.

You and your wife cannot take over your son condo because your hdb ownership has not exceed 5 years .

Your son cannot buy Or ballot for any hdb BTO within 30months from the sale of his condo .

Another point , please take note , besides the 30 months time bar , income ceiling of 14k for BTO , meaning your son and his spouse combine income Cannot exceed 14 k to qualify for BTO , or 16k for new EC executive condo .

Hi Mr Woo,

For your case, it is quite tricky as the points you have provided doesn't sound positive to what your family wishes to achieve.

For a start, your own HDB is within the 5 years MOP and that restricts you from owning another residential property. If it is commercial or industrial it is still ok. So you cannot take over your son's condo. Once you have fulfilled your 5 years MOP in 2023, you can take over your son's property but you will need to pay Additional Buyer Stamp Duty which is 12% based on the current rate.

As for your son's plan of balloting for a BTO, it cannot happen now as there is a 30 months (2.5 years) time bar after he disposes off his condo. So even if he transfers the house to you, he will still need to wait out for 30 months before he can apply. Another thing to note will be his income together with his girlfriend's income. If their total income exceeds $14K a month, then he will not be eligible to apply for the BTO too.

Although the situation sounds pretty bleak right now, what I can suggest is that we can have a meetup with you together with your son. After my partner and myself knows what you all wish to achieve in the upcoming years, maybe we can provide some advice and solutions for your family. And we can also analyse the real estate sentiments and market for you so that your family can have a better idea before making your decision on how to proceed further.

Hi Mr Woo,

You will not be able to take over ownership of your son's condo, as you have not met your 5-year MOP yet.

Should you meet your MOP, you will also incur an ABSD (12% for Singapore Citizen's 2nd residential property) on top of the normal BSD if you proceed with the transfer.

Your son will also need to wait out 30 months before he can apply for a BTO direct from HDB. He must also meet all the eligibility conditions (income ceiling, family nuclues etc).
