Hi Guru,

My wife and I have bought a EC and the TOP is July 2016. We have already gotten the keys to the EC but we have not moved in yet. However, we are now undergoing a divorce and my wife will probably get the care and control of our child. I understand that we have not reached the MOP.

1) Is there any way for me to retain the EC as a divorcee assuming that I can find enough cash to par down my mortgage loan.

2) Is it possible for me to retain the EC if both my parents decide to sell their HDB and move over with me?

3) After the court has finally approved the divorce (3 months after interim judgement is obtained), what is the maximum period of time within which my parents must sell their existing HDB in order for HDB to remove my wife from the ownership of the EC?

4) After the MOP is over, my parents decide to buy a re-sale flat. Is is possible for me to retain the EC under my name as sole ownership?

Hi,

Its best to clarify all the questions with hdb as they will be the one giving the approval, you may want to start off with the hdb branch. From my understanding you can't retain the EC under your own sole name as its not eligible. Adding your parents name may help as it forms the family nucleus to be eligible, and typically a reasonable timing of 6 months is given to sell off the hdb after their name is transferred to EC. For issues after the MOP, it depends on the regulations then. But once 5 years are up, the EC is semi privatized and can be sold to single SC or SPR no issue. It is best to clarify with hdb.

Hi,

1) There are no way to retain a new EC, as it is being classify as subsidized flat like any BTO/SBF.

2) If your parents' name are added, then a family nucleus is form. You will be able to retain the EC.

3) Your parents will have 6 months to dispose off their current flat upon successful added as owner.

4) After MOP, EC will be regards as private property status under SC & SPR. You as a sole owner will be able to retain the EC, and your parents are eligible to buy a resale HDB flat.
And they have up to 6 months to remove their name from the EC.

Dear Sir,

1) It is not possible to retain your EC as you will not be able to satisfy the family nucleus requirement by HDB.

2) Yes it is possible if your parents were included to form part of the family nucleus. However, approval from HDB is required for such unique case.

3) Your parents will be required to sell their current unit within a 6 months period.

4) Yes. After the 5 years MOP, you will be able to retain the EC under a single name as it is no longer subjected to the family nucleus requirement.
