Hi,

Currently I still have a matrimonial flat with my ex-spouse. Upon court order, my ex-spouse will be retaining the flat which I agreed. I am not quite sure with the process of doing so but what I understand that he has to buy the shares from me. And he have to do the process to terminate my name from the flat.

The flat is a 5-rm HDB (under bank loan) and have meet the requirement of MOP period. I did not contributed any of my CPF for the following flat throughout.

I have since re-married. Therefore, my husband and I require a place to stay ASAP. My main concern is, will I still be able to buy a re-sale flat with my current husband while waiting for my ex-spouse to do the process of terminating my name from the flat.

Please advice.

(Just an added information, my husband is a first-timer buyer while I'm the second-timer. And we are both working with CPF.)

Good morning,

Based on your inquiry, the court order indicated that your ex-spouse would have to purchase over your share of the unit. He would need to ink the OTP and request for valuation report after meeting the HDB resale officer on your case. The HDB officer will work on your part sales of the unit. With the valuation report, your ex-spouse would also be required to obtain the loan from bank to buy over your share of the unit.
However, unless the OTP for the part sales have been inked, I would not advice that you and your current spouse proceed for the purchase.

Hi,

First of all, although you mentioned you did not contribute any CPF for the flat, but did not mentioned whether you have pay cash for it.

So the main concern would be whether your ex-spouse has the financial capability to take over your part.

If your ex-spouse need financial assistance from bank to do so, then upon signing OTP, get valuation, and to get a letter-of-offer from bank is necessary.

The risk comes about when your ex-spouse could not get the necessary financial assistance then the whole process will be stall.

So it is only best to ensure the financial portion is done deal before committing to any purchase.
