Early termination of lease:-

Unfortunately I would have to terminate my 24 months lease early. I am looking to move to a different house in Singapore since my work place is shifted from west to east.

I know i am at fault here for breaking the lease early. Hence I am trying hard and to find an replacement tenant to take over my remaining months of the lease.

My question is:- In case I find an replacement tenant to continue my lease for rest of the contract period, without any help from the agents. Should I still have to pay the pro-rated agent commission fee ?

All terms and conditions about compensation should be listed in the tenancy agreement which can differ from the different tenancies.

It is advisable for you speak to a lawyer if you are unsure such that the lawyer can advise on the terms stated within the tenancy agreement.

    Below are the words mentioned in my TA:-
    "If this agreement should be lawfully terminated by notice in writing by the tenant before the expiry of the tenancy herein aforesaid, the tenant shall refund to the landlord, pro-ratad, the commission of $xx paid by landlord to his real estate agency. The landlord shall be entitled to deduct such refund from the deposit held by landlord. "

    so i am still a bit confused if i have to pay the agent commission or not
Hi
First of all, you need to seek approval from your landlord.
He has to agree to let you terminate your lease UPON YOU FINDING A REPLACEMENT TENANT.

Do check you Tenancy Agreement.

If everything/clause is in place, and you proceed to find a replacement tenant, USUALLY you need not pay pro-rated comm.

BUT like Geryl mentioned, do go thru your TA. I cannot be 100 pct certain as your TA may or may not be the same as ours.

    I am not in contact with owner, it is the agent who is contact with me from Day1 of my lease.
    I have informed my agent about early termination and also a replacement tenant is ready to move in. He is ok for early termination and replacement of tenant only upon payment of agent commission fee.
    hence i would like to take advise on this matter. Logically even i feel i am not supposed to pay anything. if agent helped to find an replacement tenant, then i would have happily paid the required amount.
