Early termination:

In order to fulfill the early termination, owner recommended finding the replacement for to take over the contract. The contract is for whole unit however owner locked one room and her stuff is inside the room and other parts of the house as well.

I asked owners/agent to open the room for new party, who takes over my contract, but the agent and owner are denying emptying and unlocking the room for new tenants and demanding to find same profile like me (who wont ask for the locked room).

By doing as my owner/agents requirement I might have very few or no chances to find the replacement and loose deposit of $2250.


Is it possible to claim this right against owner/agent to get out of the contract with out replacement and claim my deposit?

The room is still locked and her belongings are there too.


Please advise.

Dear outgoing tenant,

Taking over your tenancy simply means taking over the apartment as and how the apartment is being handed over to you. Since you are required to break lease in this tenancy, I suppose it is a blessing in disguise that landlord has agreed for you to look for a replacement tenant instead of having you compensate the entire contracted amount. This is 1 reason why I make it a point to explain the contractual obligations to all my landlords and tenants before day 1 such that they understand individuals' commitment towards a contract being signed.

    But in my contract it was never mentioned one room locked and i known that owner has legal right to lock one room. Until recently i found out that it is unauthorised to do so. Now they want to do the same with new tenant who wants to take over the lease. They took advantage of lack of knowledge in this matter and still trying to cheat me so that they can take over the deposit money.

    Can i claim this case or not?

Is it in your TA that owner is allowed to lock 1 room ?

or have you rented the whole unit, But allowed owner to use one of the rooms ?

    no its not written in TA. i have rented the whole unit but never allowed to use it. its a whole flat.
