Dear Gurus,

I have 2 properties held under joint in tenancy with my husband. Our 2nd property was purchased during the beginning of cooling measures and was exempted from ABSD (at that time married SG couple can have 2 properties exempted from ABSD). Fast forward now, if I buy a 3rd property now, I will be expecting 10% ABSD. If I sell off my original second property, within 6 months of my 3rd property purchase, will I get refund of the 10% ABSD that I have paid?

Good afternoon Joey,

You will not be eligible to claim back your 10% ABSD even if you sell off property B within 6 months from the purchase of property C.

ABSD remission works this way.

Both of you (married couple with one of you a SC) owns property A and will like to purchase property B. You can apply for ABSD remission as long as you sell off property A within 6 months from purchase of property B.

You will only have 1 property left.

Unfortunately no, ABSD refund is not applicable in this case as you will still have 2 property count at the end of everything. ABSD refund can only be claimed back if the property you purchase is your jointly-owned first matrimonial home.

Should you sell off your jointly-owned second property, and proceed to buy your next property, you will be liable to pay 7% ABSD if you are Singaporean.

ABSD remission is only applicable for purchase of matrimonial unit. Hence for your case, you will not able to proceed with your claim. If you have the intention to sell your second property,why not execute if first before proceeding for the purchase?
