Currently my partner is staying with his father as the sole essential occupier and will finish the MOP soon.

However if my partner and I apply the BTO aft his MOP period. Is his father able to continue staying at the current flat that they have?

If your partner's father can now qualify to hold a HDB himself (without the child as an essential occupier) then your partner can remove his name in due time so that you guys can go forward with your property plans. Otherwise, they would have to give up the flat if the father is not eligible to hold the flat himself.

Quite unlikely for the father to continue staying in the current place. Given that your partner is now an essential occupier for the flat, this term means that the father is unable to own a flat on his own, unless situation has changed for example the father has obtained Singapore Citizen, as I suspect that the father is a Permanent Resident base on the ownership arrangements for current place. If your partner is the flat owner (father is occupier):
• Once your partner applies for a BTO, HDB will treat it as owning two subsidised flats.
• Before key collection of the new BTO, your partner must dispose of the existing flat.
• That means the father cannot continue staying there unless:
• The flat is sold to an eligible buyer, or
• Ownership is transferred to the father (only possible if father meets HDB eligibility and financing rules).

If the father is the flat owner (partner is essential occupier):
• Your partner can be removed as an essential occupier after MOP.
• The father can continue staying in the flat as owner, no issue.
• Your partner is then free to apply BTO with you.

Key thing to check now:
• Who is listed as the flat owner vs essential occupier on HDB records. This single detail changes everything.

Important planning point:
• If the father is elderly or has low income, HDB may consider special appeals, but these are assessed case by case and not guaranteed. Read More
