Good morning,

I would deem that your parents had made a police report when your sister went missing in 2012. Based on international law, when one is missing for more than 7 years and there is not clear evidence that they are residing in other countries, they would be considered "DEAD". Otherwise, you would have to try to locate your sister to complete the transfer of ownership on the property that your parents had left behind, based on what have been indicated on their WILL.

Hi,

I'm sorry to hear about your loss.

It's good that you are smart enough not to listen to that "someone", because HDB will not buy 50% of the share of the flat.

According to the intestate law, all siblings will be entitled to equal share of the flat that is passed down by your parents. If you only have one sister, then both you and your sister will be entitled to 50% share of the flat.

Depending on your sister's eligibility to keep hold to the flat, she may be required to dispose off her interest of the flat, which may then result in some complications.

If your sister is deceased, then you will be 100% sole owner of the flat.

Hi,

I see your concerns as listed below:

(1) There are no will from your parents. According to intestate Succession Act, the property will be 100% fairly distribute to all children. Since you have a sister, that implied each of you own 50% of the property. You will succeed the property legally only when you turn 21 years old, before that, this shall be taking care by your guardian. They are not allow to sell the flat.

(2) So if your aunt is your guardian than you have to follow her instructions.

(3) At the meanwhile, search for your missing sister according to comrades suggested. Check whether your parents had filed any police report, if your sister remain missing for 7 years than according to international, she shall be proclaim to be "dead" by court. Than you shall entitled to 100% ownership.

(4) Finally, if you decided to continue staying there, you have all the rights to do so since you are the occupier. But you can't sign the tenancy agreement if you wish to rent out one of the room to subsidize your living, this has to be done by your guardian.
