Hi I would like to seek advice on joint tenancy information from anyone that know..

My husband currently is the owner A of the house and lives together with his parent owner B and C. Three of them are under joint tenancy. Me and my husband married and would like to purchase our own house. However, the house still under loan of 130k and can’t sell the house. His parent won’t allow. His parent is SPR and my husband is Singaporean.

I would like to know, since we intend to remove his name, he will have to return back his cpf amount. Besides paying back cpf, does he need to pay back stamp duty for montage loan or stamp duty for shares transfer? My husband intends to give his shares back to his parent. So we hope that we don’t need pay the lump sum of stamp duty, estimation 180k due to the market price of the property.

Evening Eve,

Your spouse can opt to sell the HDB to their parents under partial sales. However, his parents will need to prepare cash to refund the CPF OA and interest that your spouse have contributed. As it's also unlikely that his parents obtain any loan, they are likely to pay off the outstanding mortgage as well. Standard buyer stamp duty and ABSD of 5% will likely be payable from his parent's side.
