Hi, I understand that the diplomatic clause in tenancy agreements apply when tenant is terminated or posted to another country by the employer. Does it also apply when the occupier or tenant resigns on his/her own accord and wants to terminate tenancy prematurely and leave the country. Will the tenant be liable also for the remaining duration of the tenancy? Thanks

Morning, As indicated in the TA, being terminated or being posted overseas are not withint the control of the employee. The tenant might have issues getting another employment due to current employment ruling. However, resignation is within the employee's control. A usual tenancy agreement drafted out by an agency will usually not allow resignation of job to be included in the diplomatic clause, nevertheless, should the tenant be bent on leaving, what are the chances that he or she will leave for good without your knowledge should you decide to pursue the full legal consequences in breaching the tenancy agreement? Perhaps it could be a better idea to work things out with current tenant and see how to strike a win win situation.
