We are considering
a) converting our Joint Tenancy private property into a Tenancy in Common
and
b) then de-coupling the property to one of us, either by gift or by buyout

What are the typical amount of "legal fees" and any statutory fees that we should expect to have to pay for completing each of these ? (excluding 3% BSD on the transferred share)

Good afternoon.

Thank you for your enquiry. Assuming this is your only residential property in Singapore, typically the legal fees are approximately $6k to facilitate the decoupling process due to involvement of 2 law firms. There is also BSD on the market value of the ownership transferred (BSD on 2.5m (50% of property value)), potentially seller stamp duties (if owned less than 4 years), and also any bank penalties for early loan redemption.

Good afternoon Sir/ Mdm,

Legal fees for decoupling might varies on the property value. Good gauge is around $5.5k to $7k.

Other than this cost, other cost will buyer's stamp duty (4% if value is above $1m) and additional buyer's stamp duty (if applicable).

Just to share the staying party must have the financial capability to take over the loan and repay the CPF OA funds that outgoing party has used in existing property if any.

Hi,

1) If you intend to do a de-coupling then there is not necessary to convert from JT to TIC. You can do de-coupling in both types of ownership.
2) Decoupling fees range from $6k to $8k depending on individual law firm charges and the complication involved.
3) If there is a loan involved in your decoupling process, you are expected to pay a $500 mortgage stamp duty.

Apart from the stamp duties payable, you will need to pay legal conveyancing fees for the share transfer. It would probably work out to be in around $6,000.
