My mother passed away without a will and was the sole owner of a HDB flat. She had 3 children (including me), and I am the administrator of her flat. Under the Intestate Succession Act, the HDB flat will be distributed / inherited among her 3 children.

I will be the new proposed owner of the HDB flat and my 2 siblings will renounce their claims on the flat. This is a change in ownership not through a sale.

Currently I own a private property and am not disposing it. When I take over the flat ownership, am I subjected to BSD/ABSD as a Singaporean?

Good day to you.

You will need to apply for Grant of Letter of Administration and submit the finalized Schedule of Assets. Your siblings need to submit Renunciation of Other Beneficiaries. Upon receiving the Letter of Administration, you will need to work with HDB on the transmission process if you fulfill the eligibility requirements to own the HDB unit. HDB will then handle the rest of the procedure, which will take around 3 to 4 months.

As per IRAS website - If your inheritance is in accordance with a Will, Intestacy Law or Muslim Inheritance Law, ABSD is not payable.

However, as per HDB's website - As the remaining family, you are only allowed to retain the existing flat, provided you:
1) Are a Singapore Citizen (SC) or Singapore Permanent Resident (SPR)
2) Are at least 21 years old
3) Satisfy HDB's eligibility rules and conditions to own a flat

Buyer’s Stamp Duty (BSD) is applicable even if the transfer is not through a sale but via inheritance with renunciation by other beneficiaries.

The IRAS treats the transfer of a deceased's residential property to a beneficiary as dutiable only if:

The transfer is not solely under a will or the Intestate Succession Act, and

Some beneficiaries renounce or transfer their entitlement to another for consideration (even if no money changes hands).

Since you’re taking over full ownership and your siblings are renouncing their share, BSD will apply on the entire market value of the flat (or the part you’re inheriting from your siblings).

ABSD will also apply because you already own a private property and are not disposing it.

As a Singapore Citizen, your second residential property attracts ABSD of 20% (as of the latest rates in effect from 27 April 2023).

Since you are not selling your private property, this HDB flat will count as an additional property, triggering ABSD.

Special Note:

If all 3 children were to inherit the flat jointly without renunciation, no ABSD would apply as it’s inheritance under the Intestate Succession Act.
But since only you are taking over the entire flat and others are renouncing, IRAS will treat it as a transaction, not a pure inheritance, hence BSD and ABSD apply.

1) I'm not sure which state you are current at.
2) I'll assume you already received the legal Letter of Administration to start with.
3) Your siblings will have to submit their renuncication and indemnity Form to the Public Trustee's Office to complete their legal reunciation.
4) You may only keep the HDB flat with your private property if this is not a subsidized flat bought before 30 Aug 2010.
5) Otherwise, you will have to dispose your private property within 6 months of owning it.
6) Do note that you have to live in the inherited HDB flat for 5 years (MOP) before allowed to rent the whole unit out.
7) You are not subject to any ABSD from inheritance.
