I'm a SPR jointly owned a condo with my husband (SC) now. We are planning to purchase another condo but we would like to avoid ABSD.
Will it work if my husband transfer the current condo under my name? Hence his name is "free" to purchase his "1st property"?
I'm confused on the transfer part and heard that we have to pay a lot for it, any Guru here can advise?

Good afternoon C T,

Do take note that the transfer of ownership from your husband, for instance 50%, will be subject to buyer stamp duties (5% ABSD + 3% BSD) as well. But the overall effect will be lesser compared to both of you purchasing a second property together (10% ABSD + 3% BSD).

The transfer comes in two types, by way of gift or by way of transfer. By way of transfer is more complex. different types incurs different charges on procedures. Good evening C T,

Stamp duties are payable even by way of gift. Because when there's a transfer of ownership, stamp duties will be payable.

In regards to your earlier post, you can either choose to 1) buy private then sell or 2) sell then purchase.

The main difference is when you purchase first, you have to fork out ABSD first and apply for remission if you sell your current house within 6 months as IRAS will treat your new property as only property both of you have in Singapore. And when you sell first, you don't have to worry about ABSD as IRAS will treat that you don't have any property at the moment. But you have gauge your timing correctly, if not you might have to find temporary accomodation before shifting to new house.
