In the event of death, if the flat is held under joint tenancy, the right of survivorship means his or her share of the flat will be transferred to the family members. If it is held under tenancy-in-common the deceased party's share in the flat will be distributed according to his or her will or distributed according to the provisions of the Intestate Succession Act, if there is no will.

In your case, you may consider writing an appeal to HDB to look into your case. You will be required to show a death certificate.

By the way, if you do have strong or valid reasons, it will likely be approved in most cases but it is still base on a case or case basis. I have handled several cases before where I will be assisting seller to dispose off their flat as they have been given the green light from HDB to sell before it’s MOP, being the latest case of an Indian couple going thru divorce and their BTO flat is only just 3 years old.
